American insurers have once again found themselves in hot water as the US Court of Appeals for the Eleventh Circuit reinstated antitrust multidistrict litigation earlier this month.

The case claims that at least 10 insurance companies worked as a group to set a controversial reimbursement rate for repairs.

According to Fender Bender, bodyshops have also alleged that the insurance companies—including State Farm, Travelers, Progressive, Allstate Insurance Co., Nationwide Mutual Insurance Co., USAA, Hanover Insurance Group, 21st Century, GEICO, and Liberty Mutual Insurance—steer policyholders away from shops that charge higher rates.

Initial claims in the middle district of Florida had been dismissed however the Eleventh Circuit found sufficient evidence to indicate an agreement between the insurers and move forward with the lawsuit.
